The Council meets in Regular Session in the Council Chambers this day at 4:05 PM.

DISCLOSURES OF PECUNIARY INTEREST

 

Councillor S. Turner discloses a pecuniary interest in clause 5 of the 16th Report of the Strategic Priorities and Policy Committee, having to do with the opioid crisis in London, by indicating that his employer, the Middlesex-London Health Unit, has a significant involvement in this file.  Councillor S. Turner further discloses a pecuniary interest in clause 10 of the 12th Report of the Community and Protective Services Committee, having to do with the Business Licensing By-law review, by indicating that his employer has an enforcement role with respect to this matter.   Councillor S. Turner also discloses a pecuniary interest in clause 2 of the 21st Report of Council, In Closed Session, having to do with a property acquisition at 26 Wellington Road South, by indicating that he owns property in the area.

 

Councillor T. Park discloses a pecuniary interest in clause 13 of the 17th Report of the Planning and Environment Committee, having to do with the 10th Report of the London Advisory Committee on Heritage, specifically related to the property located at 440 Grey Street, by indicating that her family owns neighbouring property. 

 

Councillor J. Morgan discloses a pecuniary interest in clause 7 of the 16th Report of the Strategic Priorities and Policy Committee, specifically as it relates to tasks 5.3 and 6.12 of the Project Management Plan for the Rapid Transit Corridors EA, as those tasks involve his employer, the University of Western Ontario (UWO).  Councillor J. Morgan further discloses a pecuniary interest in clause 11 of the 16th Report of the Strategic Priorities and Policy Committee, having to do with an appointment to the UWO’s Board of Governors, by indicating that he is employed by UWO.

Motion made by Councillor P. Hubert and seconded by Councillor S. Turner to Approve that Council rise and go into Council, In Closed Session, for the purpose of considering the following:

 

a)

A matter pertaining to legal advice that is subject to solicitor-client privilege, including communications necessary for that purpose and advice with respect to procedural matters in connection with the Conservation Review Board recommendation relating to the Notice of Intent to designate the property located at 4402 Colonel Talbot Road. (C1/17/PEC)

 

b)

A matter pertaining to instructions and directions to officers and employees of the Corporation pertaining to a proposed disposition of land; advice that is subject to solicitor-client privilege, including communications necessary for that purpose; reports or advice or recommendations of officers and employees of the Corporation pertaining to a proposed disposition of land; commercial and financial information supplied in confidence pertaining to the proposed disposition the disclosure of which could reasonably be expected to prejudice significantly the competitive position or interfere significantly with the contractual or other negotiations of the Corporation, result in similar information no longer being supplied to the Corporation where it is in the public interest that similar information continue to be so supplied, and result in undue loss or gain to any person, group, committee or financial institution or agency; commercial, information relating to the proposed disposition that belongs to the Corporation that has monetary value or potential monetary value;  information concerning the proposed disposition whose disclosure could reasonably be expected to prejudice the economic interests of the Corporation or its competitive position; information concerning the proposed disposition whose disclosure could reasonably be expected to be injurious to the financial interests of the Corporation; and instructions to be applied to any negotiations carried on or to be carried on by or on behalf of the Corporation concerning the proposed disposition. a)         the Special Provisions, to be contained in a Subdivision Agreement between The Corporation of the City of London and 2219008 Ontario Limited, for the Silverleaf Subdivision, Phase 2 (39T-14504) appended to the staff report dated September 11, 2017 as Schedule “A”, BE APPROVED;

 

b)         the applicant BE ADVISED that the Director, Development Finance, has summarized the claims and revenues appended to the staff report dated September 11, 2017 as Schedule “B”,

 

c)         the financing for this project BE APPROVED as set out in the Source of Financing Report appended to the staff report dated September 11, 2017 as Schedule “C”; and,

That the Building Division Monthly Report for the month of June, 2017 BE RECEIVED.  (2017-A23)

 

10.

Properties located at 1175, 1185, 1195, 1205, 1215 Fanshawe Park Road West and 2151 Dalmagarry Road (Z-8776/0-8792) (Relates to Bill No. 416 and 423)

 

That, on the recommendation of the Managing Director, Planning and City Planner, the following actions be taken with respect to the application of 2415121 Ontario Ltd, relating to the properties located at 1175, 1185, 1195, 1205 and 1215 Fanshawe Park Road West and 2151 Dalmagarry Road:

 

a)         the proposed by-law appended to the staff report dated September 11, 2017 as Appendix "A" BE INTRODUCED at the Municipal Council meeting to be held on September 19, 2017 to amend the Official Plan by ADDING a policy to section 10.1.3 – Policies for Specific Areas – that would permit a Restricted Automotive Use without a car wash;

 

b)         the proposed by-law appended to the staff report dated September 11, 2017 as Appendix "B" BE INTRODUCED at the Municipal Council meeting to be held on September 19, 2017 to amend Zoning By-law No. Z.-1, (in conformity with the Official Plan as amended in part a) above), to change the zoning of the subject property FROM a Neighbourhood Shopping Area Special Provision (NSA5(8)) Zone TO a Neighbourhood Shopping Area Special Provision (NSA5(_)) Zone; 

 

it being noted that no individuals spoke at the public participation meeting associated with this matter;

 

it being further noted that the Municipal Council approves this application for the following reasons:

 

•           the recommended Official Plan and Zoning By-law amendment is consistent with the Provincial Policy Statement 2014;

•           the recommended Official Plan amendment to add a restricted automotive use (without a carwash) to the list of uses permitted on the subject is consistent with the policies of Chapter 10 (Policies for Specific Areas) of the City of London Official Plan, as amended; and,

•           the recommended zone facilitates increased usability of the subject site by accommodating uses that are similar to, and compatible with, the existing uses in the surrounding area; 

•           the proposed building and on-site parking is capable of supporting the requested service station without resulting in any negative impacts to abutting uses; and,

•           the recommended Official Plan and Zoning By-law amendment to expand the list of permitted uses is consistent with, and serves to implement, the use, intensity and form policies of the Shopping Area Place Type of the London Plan.   (2017-D09)

That the communication dated September 1, 2017, from  P. Lombardi, Partner, Siskinds, with respect to the potential inclusion of the property located at 1108 Dundas Street (EMCO building) into the Inventory of Heritage Resources, BE RECEIVED.  (2017-R01)

The 8th report of the Advisory Committee on the Environment

 

That the following actions be taken with respect to the 8th Report of the Advisory Committee on the Environment from its meeting held on September 6, 2017:

 

a)         the comments appended to the 8th Report of the Advisory Committee on the Environment (ACE), dated August 8, 2017, from the Accessibility Advisory Committee with respect to the Draft Urban Agriculture Strategy BE FORWARDED to L. Maitland, Planner I, for consideration;

b)         the request for a representative for the Transit Project Assessment Process Municipal Advisory Group, dated August 25, 2017, from J. Ramsay, Project Director, BE DEFERRED to the next meeting of the Advisory Committee on the Environment to allow the Committee Secretary to obtain information on the expected meeting dates;

 

c)         the revised comments of the ACE, appended to the 8th Report of the ACE, related to the Draft Urban Agriculture Strategy BE FORWARDED to L. Maitland, Planner I, for consideration; and,

 

d)         clauses 1 to 6, 9 to 11, BE RECEIVED.

Conservation Review Board Recommendation - Notice of Intent to Designated 4402 Colonel Talbot Road

 

That the Notice of Intention to designate the property located at 4402 Colonel Talbot Road BE WITHDRAWN pursuant to Section 29(14b) of the Ontario Heritage Act, causing a notice of withdrawal to be served on the property owner, the Ontario Heritage Trust and to be published in The Londoner;

 

it being noted that the Planning and Environment Committee reviewed and received the following communications with respect to this matter:

 

•           a communication dated September 6, 2017 from M. Bloxam, Architectural Conservancy Ontario - London Branch;

•           a communication dated September 7, 2017 from M. Whatley, Administrative Assistant, Lambeth Health Organization; and,

•           a communication dated September 7, 2017 from T. Christensen, by e-mail.

 

At 5:07 PM, His Worship the Mayor places Councillor P. Hubert in the Chair, and takes a seat at the Council Board.

 

At 5:09 PM, His Worship the Mayor resumes the Chair, and Councillor P. Hubert takes his seat at the Council Board.

a)         the staff report, dated September 11, 2017, and the report from the Conservation Review Board, appended to the report as Appendix A, BE RECEIVED;

 

b)         the property at 4402 Colonel Talbot Road BE DESIGNATED under the provisions of Section 29 of the Ontario Heritage Act as a property of cultural heritage value or interest, with the statement explaining its cultural heritage value or interest and identifying heritage attributes appended to this report as Appendix B; and,

 

c)         the City Clerk BE DIRECTED to introduce a by-law to designate the property at 4402 Colonel Talbot Road at the next Council Meeting.

Benjamin Vasquez, Vice-Chair, London Advisory Committee on Heritage re: 10th Report of the London Advisory Committee on Heritage

 

That the following actions be taken with respect to the 10th Report of the London Advisory Committee on Heritage from its special meeting held on September 6, 2017:

 

a)         on the recommendation of the London Advisory Committee on Heritage (LACH), the Municipal Council BE REQUESTED to consider the designation of the property located at 440 Grey Street, as the property is of cultural or heritage value or interest, pursuant to Section 29 of the Ontario Heritage Act, based on the revised Statement of Cultural Heritage Value or Interest appended to the 10th Report of the LACH; it being noted that the subject property is located within the “SoHo” area, which has been identified as a potential Heritage Conservation District;

a)         that the value of the Purchase of Service Agreement with Cargo Management Consulting Inc. for the implementation of a Homeless Management Information System in accordance with Request for Proposal 16-56, at a total cost of $649,500 plus HST, BE INCREASED by $76,055 to a revised total of $725,555 plus HST for one-time costs associated with the start-up of the Information System;

 

b)         that Civic Administration BE AUTHORIZED to undertake all the administrative acts that are necessary in relation to this project;

 

c)         that approval given herein BE CONDITIONAL upon the Corporation entering into an amended Community Homelessness Prevention Initiative Purchase of Service Agreement with Cargo Management Consulting Inc.; and,

London’s Homeless Prevention System - Homelessness Partnering Strategy - Homeless Individuals and Families Information System -  Data Provision Agreement (Relates to Bill No. 414)

 

That, on the recommendation of the Managing Director, Neighbourhood, Children and Fire Services, with the concurrence of the Director, Information Technology Services, the proposed By-law, as appended to the staff report dated September 12, 2017, BE INTRODUCED at the Municipal Council meeting to be held on September 19, 2017, to:

 

a)         approve the Data Provision Agreement, as appended to the above-noted proposed by-law, between Her Majesty the Queen in Right of Canada as represented by the Minister of Employment and Social Development (ESDC) and The Corporation of the City of London;

 

b)         delegate to the Managing Director, Neighbourhood, Children and Fire Services, or their designate, the authority to undertake all the administrative acts that are necessary in connection with the Data Provision Agreement approved in part a) above, on the condition that no additional funding is required, or if additional funding is required it is provided for in the City’s current budget, and that there is no increase in indebtedness or contingent liabilities of The Corporation of the City of London; and,

That, on the recommendation of the Managing Director, Neighbourhood, Children and Fire Services, the proposed By-law, as appended to the staff report dated September 12, 2017, BE INTRODUCED at the Municipal Council meeting to be held on September 19, 2017, to:

 

a)          approve the Funding Agreement, as appended to the above-noted by-law, between Her Majesty the Queen in Right of Canada as represented by the Minister of Employment and Social Development styled as Minister of Families, Children and Social Development and The Corporation of the City of London, to receive new funding under the Homelessness Partnering Strategy;

 

b)          delegate to the Managing Director, Neighbourhood, Children and Fire Services, or designate, the authority to undertake all the administrative and financial acts that are necessary in connection with the above-noted Funding Agreement, on the condition that no additional funding is required, or if additional funding is required it is provided for in the City’s current budget, and that there is no increase in indebtedness or contingent liabilities of The Corporation of the City of London; and,

7th Report of the Animal Welfare Advisory Committee

 

That the following actions be taken with respect to the 7th Report of the Animal Welfare Advisory Committee from its meeting held on August 3, 2017:

 

a)         that the Managing Director, Environmental & Engineering Services and City Engineer BE REQUESTED to provide a presentation to the Animal Welfare Advisory Committee with respect to the overall nature of the modifications of the Hyde Park Storm Sewer and how the modifications will affect wildlife; it being noted that a verbal update from W. Brown, on behalf of the Animal Welfare Advisory Committee Working Group, was received;

 

b)         that the Municipal Council BE REQUESTED to consider the following amendments to the Animal Welfare Advisory Committee (AWAC) Terms of Reference:

 

i)          the Urban League of London position be eliminated and an Animal Rescue Group be added in its place;

ii)         the London Veterinarian Association position be eliminated as this organization is no longer in existence and a Member-at-Large be added in its place;

iii)         the London Humane Society position be eliminated and a Wildlife Rehabilitator/Naturalist be added in its place; and,

iv)        the Citizens for Companion Animals position be eliminated and a Member-at-Large be added in its place; and,

 

c)         clauses 1, 2, 4 to 6 and 8, BE RECEIVED;

Ontario Works Rates

 

That the following actions be taken with respect to Ontario Work Rates:

 

a)         the campaign for Ontario Works rates for single adults to be increased by $245.00 per month, as presented in the attached presentation by A. Oudshoorn and D. Peckham of the London Homelessness Coalition BE ENDORSED; and,

 

b)         the Mayor BE REQUESTED to write a letter to the Minister of Community and Social Services as well as the City of London MPPs and the leaders of the opposition parties, indicating the City of London’s support to increase the Ontario Works rates.

Shared Rail - Trail Link Along the CN Talbot Spur Line

 

That the City Manager BE DIRECTED to:

 

a)         begin more formal discussions with CN, the City of St. Thomas and Elgin County with respect to the possibility of a shared rail-trail link along the CN Talbot Spur Line;

 

b)         explore possibilities for funding through other levels of government in support of improved cycling opportunities; and,

b)         amendments to proposed clauses 2.4 and 2.5 so that they now read as follows:

 

“2.4       No person shall Place or permit to be placed an Election Sign outside of the Electoral District where the Candidate is running for office.

 

2.5       Section 2.4 does not apply to an Election Sign within 50 metres of any Electoral District that is adjacent to the Electoral District where the Candidate is running for office.”; and

 

c)         addition of the following definitions:

That the following actions be taken with respect to the use of supervised consumption sites and other harm reduction measures:

 

a)         the Opioid Crisis Working Group, comprised of the Mayor, as well as other community stakeholders, under the leadership of the Medical Officer of Health, BE ENDORSED;

 

b)         the Medical Officer of Health & CEO, Middlesex-London Health Unit BE ADVISED that the Municipal Council endorses the Health Unit’s and the Opioid Crisis Working Group’s further study and consultation with community stakeholders regarding the use of supervised consumption sites and other harm reduction measures; and

 

c)         the Opioid Crisis Working Group BE REQUESTED to report back to the Municipal Council with details of its relationship with other strategies and working groups, and proposed terms of reference for the Working Group that would provide for:

 

i)          consultation with the community;

ii)         exploration of a response to the current situation, including the possibility of supervised consumption sites; and,

iii)         development of recommendations as to how to best address the opioid crisis in London;

 

it being understood that the Working Group will liaise with the Civic Administration in the development of the proposed terms of reference, including establishing a timeline for completion of the Working Group’s mandate;

That, on the recommendation of the Managing Director, Corporate Services and City Treasurer, Chief Financial Officer, on the advice of the Manager of Realty Services, the following actions be taken with respect to the acquisition of lands required for an dedicated access for the 23.9 Acre Parcel (known as C5) at Huron Industrial Park and the disposal of part of the 23.9 Acre Parcel (C5) to the abutting property owner:

 

a)         the offer submitted (attached as Schedule “B”) by Zero 33 Development Corporation to sell to the City a portion of the lands located on the north side of Jetstream Road, further described as Part of Lot 2 Concession 2 in the Geographic Township of London, City of London, County of Middlesex being Parts 78, 79 and Part of Part 82 on Plan 33R-4254 being part of PIN 081260115, to be defined on a reference plan to be deposited in the City of London, County of Middlesex, containing an area of approximately 0.84 acres, for the purpose of  an access for the 23.9 acre parcel referred to as C5 at Huron Industrial Park,  for the sum of $2.00 Dollars, BE ACCEPTED subject to the following conditions:

 

i)          the City having thirty (30) days from acceptance to satisfy itself as to the title of the property;

 

ii)         the City accepting the Property on an “as-is” basis;

b)         the offer submitted (attached as Schedule “C”) by Zero 33 Development Corporation to purchase from the City the lands located on the south side of Veteran’s Memorial Parkway and north of Jetstream Road, further described Being Part of the north half of Lot 2 Concession 2 in the Geographic Township of London, City of London, County of Middlesex, as part of Part 15 on Plan 33R-1376, being part of PIN 081260018, to be defined on a reference plan to be deposited in the City of London, County of Middlesex, containing an area of approximately 2.16 acres, for the sum of $2.00 Dollars, BE ACCEPTED subject to the following conditions:

 

i)          the Purchaser having thirty (30) days from acceptance to satisfy itself as to the title of the Property;

 

ii)         the Purchaser accepting the Property on an “as is” basis;

2.         Property Acquisition – 26 Wellington Road South SHIFT Rapid Transit Project

 

That, as a procedural matter pursuant to Section 239(6) of the Municipal Act, 2001, the following recommendation be forwarded to Council for deliberation and a vote in public session:

 

That, on the recommendation of the Managing Director, Corporate Services and City Treasurer, Chief Financial Officer, with the concurrence of the Managing Director of Environmental and Engineering Services and City Engineer, the Director, Roads and Transportation and the Project Director, Rapid Transit Implementation, on the advice of the Manager of Realty Services, the following actions be taken with respect to the property located at 26 Wellington Road South, further described as Lot 19, Plan 11, having a lot size of approximately 33 x 133 feet, as shown on the location maps attached, for the purpose of future road improvements to accommodate SHIFT:

 

a)         the offer submitted by Marilyn Carol Bates to sell the subject property to the City, for the sum of $169,900.00, BE ACCEPTED subject to the following conditions:

 

i)          the City having the right to view the property two further times prior to closing;

 

ii)         the City assuming the rental contract for the hot water tank;

 

iii)         the transaction including all existing fixtures and chattels; and
